1. Acceptance of Terms

By accessing or using the job application portal operated by dotCLOUD (the “Company”, “we”, “us”, or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and the Company under Swiss law.

2. Description of Our Service

Our website is a dedicated platform for publishing job openings and enabling direct online applications. The Service allows candidates to submit applications for specific positions published on the platform.

3. Job Applications

3.1 When you submit an application, you provide personal data and documents (including CV, certificates, references, etc.) directly through our secure upload form.

3.2 Each application is processed exclusively for the specific position you apply for.

3.3 Submission of an application constitutes your explicit consent to the processing of your data in accordance with these Terms and applicable Swiss data protection law (Federal Act on Data Protection – FADP).

4. User Obligations

You represent and warrant that:

All information and documents you provide are accurate, complete, and truthful;
You have the right to provide such documents (including any third-party data contained therein);
You will not upload any content that is unlawful, discriminatory, or infringes third-party rights.

5. Data Protection & Privacy

                Important Notice on Data Handling (in accordance with the Swiss Federal Act on Data Protection – FADP):
            

5.1 Purpose of processing
Your personal data and application documents are collected and processed exclusively for the purpose of evaluating your application for the specific job position you applied for. No other use is made of your data.

5.2 Storage
Upon upload, all data is stored directly and securely in our Microsoft Azure Tenant located in a Swiss or EU data center compliant with Swiss data protection standards. No data is stored on local servers outside this environment.

5.3 Access
Access to your application data is strictly limited to internal employees of the Company who have been granted administrator rights on the platform and who are involved in the recruitment process. All such employees are bound by strict confidentiality obligations.

5.4 No sharing or transfer
Your data will never be shared with third parties, sold, rented, or used for marketing, profiling, or any other purpose outside the specific recruitment process. There are no international transfers outside the scope permitted under Swiss law.

5.5 Deletion policy
Your complete application dossier (including all personal data and uploaded documents) will be permanently and irreversibly deleted from our systems immediately upon conclusion of the recruitment process. This occurs automatically in the following cases:

You receive an acceptance or rejection for the position;
The position is filled by another candidate;
The position is cancelled or withdrawn.

No backups or residual copies will be retained beyond this point.

5.6 Your rights
Under the FADP you have the right to information, rectification, deletion, and restriction of processing. Because deletion occurs automatically at the end of the process, you may exercise these rights by contacting us at any time prior to deletion using the contact details below.

5.7 Security
We implement appropriate technical and organisational measures (including encryption in transit and at rest) to protect your data against unauthorised access, loss, or alteration.

6. Intellectual Property

All content on the website, including text, graphics, logos, and software, is owned by or licensed to the Company and protected by Swiss and international copyright laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

7. Disclaimers and Limitation of Liability

7.1 The Service is provided “as is”. We do not guarantee that any position will remain open, that you will be invited to an interview, or that you will receive an offer.

7.2 To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.

7.3 Our total liability shall in no event exceed CHF 500.

8. Termination and Deletion of Data

We reserve the right to refuse or remove any application that violates these Terms. Upon termination of the recruitment process or closure of your application, all your data will be deleted in accordance with Section 5.5 above.

9. Governing Law and Jurisdiction

These Terms are governed exclusively by substantive Swiss law, excluding conflict-of-law rules. Any disputes shall be subject to the exclusive jurisdiction of the courts of [City, e.g. Zurich], Switzerland.

10. Changes to These Terms

We may update these Terms from time to time. The new version will be posted on the website with an updated “Effective Date”. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
